HB 1045 Summary

• Limits damages recovery for uninsured motorists to medical costs, property damage, and lost income only (excludes pain and suffering awards).

• Exceptions allow full damages recovery if the at-fault driver was under the influence of drugs or alcohol, intentionally caused the accident, left the scene, or was committing a felony.

• Exceptions also apply to passengers, pedestrians, minors claimed as dependents on parent tax returns, and wrongful death claims.

• Both the liable party and their motor vehicle liability insurer may assert the recovery limitations.

• Effective date: November 1, 2011.
