HB 1048 Summary

• Amends 58 O.S. 2001, Section 946 regarding presumed death in probate proceedings.

• Requires that any decree declaring a person legally dead must include the decedent's full legal name, aliases, name at birth, date of birth, place of birth (city and state), Social Security number, and parents' full names (including mother's maiden name).

• Mandates that a certified copy of the decree be delivered to the State Department of Health, Division of Vital Records so the state of birth can be notified.

• Prohibits the Division of Vital Records from issuing a death certificate unless the requirements of Section 5-1 of Chapter 105 of Title 310 of the Oklahoma Administrative Code are met.

• Effective date: November 1, 2011.
