HB 1250 Summary

• Creates the "Oklahoma Any Willing Institute Act" to regulate health insurance provider networks and prevent discrimination against health care institutes willing to meet plan terms and conditions.

• Prohibits health insurers from imposing monetary advantages, penalties, higher copayments, or reduced reimbursement that would influence beneficiary selection among participating health care institutes.

• Allows health insurers to maintain quality control measures and cost-control programs (such as gatekeeper systems) if applied equally to all institutes in the same class.

• Applies to all health insurers, HMOs, PPOs, and related entities; excludes self-funded ERISA plans and noninsurer provider networks unless directly contracted by insurers.

• Provides private right of action for injunctive relief (not damages) for institutes harmed by violations; grants Insurance Commissioner enforcement authority; effective November 1, 2011.
