HB 1413 Summary

• Establishes the "Home Appliance Lemon Law" to protect consumers who purchase new home appliances (refrigerators, freezers, ranges, ovens, stoves, microwaves, washers, dryers, dishwashers, garbage disposals, trash compactors, and room air conditioners) with a wholesale price of at least $200.

• Requires manufacturers to repair nonconforming home appliances to meet express warranties within one year of original delivery or during the warranty term, whichever is earlier.

• Provides for refund of full purchase price (minus reasonable depreciation allowance) or replacement with comparable model if appliance cannot be repaired after a reasonable number of attempts (presumed to be 4+ repairs or 30+ business days out of service).

• Mandates the Oklahoma Attorney General prepare and publish a written statement explaining consumer rights under this law, which retail dealers must provide to purchasers at time of sale.

• Allows consumers who prevail in civil actions to recover all costs and reasonable attorney fees; restricts resale of returned appliances unless same warranty is provided or manufacturer discloses in writing why appliance was reacquired.
