HB 1608 - School District Reorganization Act Summary

• Creates the School District Reorganization Act, requiring the State Department of Education to publish an annual administrative reorganization list of school districts with fewer than the average number of students in surrounding states (Texas, Arkansas, Missouri, Kansas, Colorado, New Mexico).

• Allows school districts on the reorganization list to voluntarily reorganize by submitting a petition to the State Board of Education by March 1, with reorganization to be completed by May 1 and effective July 1.

• Requires districts on the list that do not voluntarily reorganize or do not receive Board approval to be mandatorily reorganized by the Board by May 1, effective July 1.

• Establishes that reorganized districts must have an average student enrollment equal to or greater than the surrounding states' average, prohibits closures of school facilities for three years after reorganization, limits each reorganized district to one superintendent, and prohibits reorganizations that negatively affect school desegregation.

• Authorizes noncontiguous school districts in the same county to reorganize with Board approval, allows contiguous districts to reorganize across county lines, and requires resulting districts to retain all student records and historical artifacts from affected districts.
