HB 1745 Summary

• Allows parents to petition the State Board of Education to assume control of schools that fail to make adequate yearly progress (AYP) for one or more years and are identified for school improvement, if more than 50% of parents sign the petition.

• The State Board of Education retains all funds normally allocated to the school district based on the school's average daily membership to operate the school.

• The State Board may either operate the school directly through the State Department of Education or implement alternative governance arrangements such as charter school conversion, staff replacement, private management contracts, or other major restructuring.

• For schools identified as persistently low-achieving, district boards must implement one of four intervention models: turnaround model (replace principal, rehire up to 50% staff), restart model (charter conversion), school closure, or transformation model (replace principal, improve staff effectiveness, reform instruction, increase learning time, provide operational flexibility).

• The act becomes effective July 1, 2011, with an emergency clause allowing immediate effect upon passage and approval.
