Amends 70 O.S. 2001, Section 1-114 relating to free school attendance to authorize school districts to charge fees to students not lawfully present in the United States.

School districts may charge fees for enrollment in non-credit courses or activities, and for materials, activities, or privileges not related to recognized academic or educational goals.

Prohibits school districts from preventing students from enrolling, receiving grades, graduating upon completion of requirements, or obtaining school records based on immigration status.

Defines "lawfully present" as having permanent resident status, temporary nonimmigrant status, U.S. citizenship, or U.S. nationality in accordance with immigration laws.

Effective July 1, 2011 with an emergency declaration for immediate implementation.
