HB1872 Summary

• Requires nursing facilities to maintain liability insurance of at least $200,000 per occurrence for patient negligence injuries.

• Mandates annual proof of insurance on a standardized form promulgated by the Oklahoma Health Care Authority, to be kept on file at the facility.

• Allows exemption from license suspension/revocation if facility cannot secure insurance due to financial hardship or lack of willing underwriters, provided the facility notifies patients and the Authority.

• Requires facilities without insurance to provide annual written notice to patients, relatives, or guardians explaining the reason for lack of coverage, but does not protect the facility from negligence liability.

• Failure to maintain, renew, or keep insurance at required levels is grounds for suspension or revocation of the nursing facility license under the Nursing Home Care Act; effective November 1, 2011.
