HB 2086 Summary

• Establishes the Quality of Education Assessment for Oklahoma Citizens Act of 2011, requiring public schools to determine and document the citizenship and immigration status of enrolled students at time of enrollment.

• Schools must verify citizenship status using original or certified birth certificates, and parents must notify schools within 30 days if child was born outside the U.S. or birth certificate unavailable, including presentation of documentation establishing citizenship/immigration status.

• School districts must compile citizenship and immigration status data in aggregate form by school site without identifying individual students, then submit annual reports to the State Department of Education.

• The State Superintendent must compile district data into an annual statewide public report showing numbers of citizens, noncitizens by immigration classification, and English language learners by district, and analyze impacts on education quality for citizen students.

• Prohibits public disclosure of information that individually identifies any student except as permitted under federal law (8 U.S.C. §§ 1373 and 1644), with civil remedies available for unauthorized disclosure; takes effect November 1, 2011.
