Amends 70 O.S. 2001, Section 13-107 relating to federal funds for special education and exceptional children education

Directs the State Board of Education to develop a funding mechanism for distributing federal funds to reimburse local educational agencies for excessive costs of high-need students with individual education programs (IEPs)

Requires the excess cost-funding mechanism to divide available federal funds evenly between: (1) out-of-state residential placement costs for high-need students, and (2) other excessive costs to local education agencies for high-need students

Defines "excessive costs" as costs at least three times the average per pupil expenditure in Oklahoma where total excessive costs of all high-need students equal at least 10 percent of the local education agency's flow-through allocation

Declares an emergency, making the act effective immediately upon passage and approval
