Amends 21 O.S. 2001, Section 1158 to establish a priority order for who has the right to control disposition of a deceased person's remains, replacing the previous duty of burial framework.

Creates forfeiture provisions allowing the right of disposition to pass to the next qualifying person if someone is charged with murder/manslaughter related to the death, fails to exercise the right within 3-5 days, or is estranged from the decedent as determined by district court.

Establishes district court authority to award the right of disposition to the most appropriate person and to resolve disputes among family members holding equal priority, with specific factors for the court to consider.

Provides funeral directors protection from liability when relying in good faith on funeral service agreements and authorizations, and allows them to proceed with disposition and recover charges when no qualified person can be located.

Effective July 1, 2011, with an emergency clause allowing the act to take effect immediately upon passage and approval.
