HJR 1017 Summary

• Creates a new Section 9A-1 in Article X of the Oklahoma Constitution to establish a special funding mechanism for county roads and bridges beginning July 1, 2013.

• Requires county treasurers to compute county general fund millage revenues separately, with 50% of revenue derived from increases in taxable values (real property, personal property, and public utility property) directed to a new County Road and Bridge Construction and Improvement Growth Revenue Fund.

• Restricts the new road and bridge fund to only be used for engineering, planning, construction, maintenance, improvement, and repair of county roads and bridges, except those revenues cannot fund state purposes (with limited exception for state highway system roads).

• Specifies that enabling legislation may be enacted by the Legislature but cannot modify the formula for determining revenue amounts apportioned to the road and bridge fund.

• Directs the Secretary of State to refer the proposed amendment to voters with a specified ballot title explaining that 50% of tax increases would fund roads/bridges while 50% continues to the general fund.
