SB156 - Small Claims Procedure Summary

• Increases the monetary limit for small claims actions from $6,000 to $10,000 for contract, tort, and replevy claims.

• Raises the attorney fee cap in uncontested cases from 10% to 20% of the judgment amount.

• Requires small claims affidavits to include a disclaimer acknowledging the plaintiff is waiving the right to a trial by jury.

• Modifies the timeline for defendants to file transfer motions from 48 hours to within 4 days after service or 48 hours before the appearance deadline, whichever is earlier.

• Becomes effective November 1, 2011.
