Amends 66 O.S. 2001, Section 304 relating to powers and duties of the Department of Transportation regarding railroads.

Replaces references to "Interstate Commerce Commission" with "Surface Transportation Board" in department compliance requirements.

Maintains Department of Transportation's existing authority to acquire, construct, operate, and maintain railroad rights-of-way and trackage projects.

Preserves department powers to enter agreements with railroad owners, sell or lease state-owned railroad property, and receive federal and private funds for railroad assistance programs.
