Amends 52 O.S. 2001, Section 318.5 regarding surface damages from oil and gas drilling operations on privately owned land.

Removes requirement that damage trials be conducted in the same manner as railroad condemnation actions, allowing damages to be determined by standard jury trial procedures instead.

Maintains existing process where operators must negotiate with surface owners or petition courts for appraiser appointment before entering drill sites; appraisers assess damages and compensation.

Provides that if a party demands jury trial and does not receive a more favorable verdict than the appraisers' award, all court costs including attorney fees are assessed against that party.

Takes effect July 1, 2011, with emergency clause for immediate enactment.
