Parents or legal guardians of kindergarten and certain first-grade students in public schools must provide proof of an oral examination by a licensed dentist or dental hygienist performed within 12 months before enrollment, by May 31 of the school year.

Exemptions available if parents can demonstrate undue financial burden, lack of access to dental services, or non-consent to the examination.

School districts must notify parents of requirements and submit annual reports to the State Department of Health with data on student compliance, reasons for non-compliance, and untreated decay findings.

The State Department of Education must develop a standardized form for documenting oral examinations and exemptions; the State Department of Health must evaluate improvements in oral health and report findings to the Legislature by January 1, 2015.

The act becomes effective July 1, 2011, with an emergency declaration allowing immediate implementation.
