SB 334 Summary

• Creates "Tabby's Law" establishing an Electronic Monitoring Program for persons registered as sex offenders under the Sex Offenders Registration Act.

• Imposes an annual $75 fee on all registered sex offenders to be deposited into the Sex Offender Electronic Monitoring Revolving Fund administered by the Department of Corrections.

• Requires electronic monitoring via GPS devices for certain sex offenders, including those convicted of specific felonies (Sections 741, 843.5, 865, 885, 888, 891, and certain provisions of Section 1021 of Title 21) and those who violate registration requirements or commit additional offenses.

• Increases penalties for sex offender registration violations from 5 years imprisonment and $5,000 fine to 10 years imprisonment and $100 daily fines until registration occurs; creates new felony for removing electronic monitoring devices with penalties of 1-10 years imprisonment and $1,000-$10,000 fine.

• Requires electronic monitoring for 10 years (for certain offenses) or 15 years (for other specified crimes) after release, with lifetime monitoring required for repeat offenders; effective November 1, 2011.
