SB7 Summary

• Prohibits intentional participation in preparing, disseminating, or broadcasting false political advertising, campaign material, or letters to editors that the person knows are false or spreads with reckless disregard for truthfulness.

• Makes it unlawful to make false claims about a candidate or ballot measure having the support or endorsement of a party committee, or to claim support from individuals/committees without written permission.

• Applies to advertising or material relating to a candidate's character, voting record, or a ballot measure's effects when designed to elect, injure, promote, or defeat candidates or measures.

• Excludes from liability persons whose sole business role is printing, manufacturing, or disseminating such material in the normal course of business.

• Violations constitute a misdemeanor punishable by a fine of up to $5,000, imprisonment up to one year, or both; effective November 1, 2011.
