Patients have the right to access and obtain copies of medical records, including x-rays, photographs, images, and pathology slides from doctors, hospitals, and other medical institutions.

Disclosure of records for deceased patients requires a court order or written release from an executor, administrator, personal representative, or responsible family member (defined as parent, adult child, adult sibling, or other adult relative actively involved in patient care).

Copy costs are capped at $1.00 for the first page and $0.50 for each subsequent page; digital records may be produced at $0.12 per digital page; x-rays and images are limited to $5.00 or actual reproduction cost, whichever is less.

No mailing fees may be charged for copies provided by facsimile; medical providers cannot charge fees for searching, retrieving, reviewing, and preparing records, only for actual mailing costs.

Effective date is November 1, 2011.
