Oklahoma Department of Transportation is authorized to file applications with the U.S. Department of Transportation to assume all or part of National Environmental Policy Act (NEPA) responsibilities under 23 U.S.C. sections 325, 326, and 327.

ODOT is authorized to enter memoranda of understanding with USDOT and may explicitly waive state sovereign immunity from suit under the Eleventh Amendment to enforce assumed environmental responsibilities.

ODOT is authorized to adopt implementing regulations and environmental standards necessary to carry out NEPA responsibilities and to cooperate with federal agencies.

The bill includes an emergency clause declaring the act necessary for preservation of public peace, health and safety, making it effective immediately upon passage and approval.
