SB 785 Summary

• Amends 47 O.S. Section 904 to clarify that an additional release from a registered vehicle owner is not required when an insurer has determined a vehicle to be a total loss.

• Amends 47 O.S. Section 953.1 to specify that wrecker and towing operators can collect fees from owners, lienholders, agents, or insurers accepting liability for total loss vehicles.

• Clarifies that no additional release from the registered vehicle owner is necessary in cases where an insurer has determined the vehicle to be a total loss and authorizes release to insurance pool yards for sale.

• Maintains existing maximum fee schedules for wrecker services including distance rates, hourly rates, hookup rates, and additional service rates, with weekly fuel surcharge adjustments.

• Effective date: November 1, 2011.
