Eliminates incarceration as a penalty for first-time nonviolent drug offenses under the Uniform Controlled Dangerous Substances Act for persons with no other criminal convictions (excluding traffic violations).

Requires alternative punishments including fines, probation, and community service of at least 150 hours for those who qualify under the new provision.

Amends Sections 2-401, 2-402, 2-404, and 2-405 of Title 63 (Oklahoma Statutes) to align existing drug offense penalties with the new non-incarceration requirement for qualifying first offenders.

Maintains incarceration penalties for violent offenses, repeat offenders, distribution near schools/parks, and offenses involving large quantities of controlled substances.

Effective November 1, 2011.
