SB 871 Summary

• Amends Oklahoma criminal law (21 O.S. 2001) to except murder in the first degree from duress and involuntary subjection defenses.

• Modifies Section 152 to exclude first-degree murder from the defense of involuntary subjection to a superior's power.

• Modifies Section 155 to exclude first-degree murder from the duress defense related to involuntary subjection.

• Modifies Section 156 to exclude first-degree murder from the duress defense when a person commits an act due to reasonable belief of imminent danger of death or great bodily harm.

• Effective November 1, 2011.
