SB 893 Summary

• Creates the Jerome Ersland Act establishing a rebuttable presumption that a homicide is justified when the deceased was committing armed robbery at or shortly before the incident that caused their death.

• The presumption applies only when the homicide occurs on the same property where the armed robbery took place.

• The presumption can be rebutted by clear and convincing evidence that the homicide was not committed in self-defense or defense of others.

• Codifies the provision as Section 734 of Title 21 of the Oklahoma Statutes.

• Becomes effective November 1, 2011.
