SB 894 Summary

• Creates the "Jerome Ersland Act" establishing a presumption that homicide is justified in self-defense or defense of others when the deceased was engaged in armed robbery at or shortly before the death.

• Presumes justified homicide when three conditions are met: the deceased was engaged in armed robbery, the homicide occurred in close temporal proximity to the robbery, and the homicide occurred on the property where the armed robbery took place.

• Makes the presumption rebuttable only by clear and convincing evidence that the homicide was not in self-defense or defense of others.

• Effective date: November 1, 2011.
