ENGROSSED SENATE BILL NO. 908 - Summary

• Creates new felony offense for intentionally smuggling human beings for profit or commercial purpose, with punishment of 1+ years imprisonment or minimum $1,000 fine or both.

• Prohibits state and local governmental agencies from limiting or restricting law enforcement enforcement of federal immigration laws, including investigation of federal alien registration violations.

• Authorizes law enforcement to seize and forfeit vehicles and property used in human smuggling or unlawful harboring of aliens; requires detainers for confirmed unlawfully present aliens and permits secure transport to federal custody.

• Expands employment verification requirements by mandating employers receiving economic development incentives participate in e-verify program and prohibits day laborers from commencing employment without completing federal employment authorization attestation.

• Establishes criminal penalties for accepting consular identification or individual taxpayer identification numbers as valid public identification (except for tax reporting purposes), effective January 1, 2012.
