Amends Oklahoma discovery rules (12 O.S. 2001, Section 3226) to modify procedures for discovering trial preparation materials created in anticipation of litigation.

Changes standard for discovering trial preparation materials from requiring attorney work product protection to allowing discovery if materials are otherwise discoverable and the requesting party shows substantial need and cannot obtain equivalent materials without undue hardship.

Adds new protections for attorney-expert communications by restricting discovery of communications between attorneys and retained experts regarding compensation, facts/data provided, and assumptions relied upon in forming expert opinions.

Establishes that a previous statement made by a party or person is either: (1) a signed written statement adopted by the person, or (2) a contemporaneous stenographic/electronic recording substantially reciting the person's oral statement.

Effective date: November 1, 2011.
