HB 1045 Summary

• Limits damage recovery in motor vehicle accident claims for uninsured plaintiffs to medical costs, property damage, and lost income only (excludes pain and suffering awards)

• Provides seven exceptions where full damages including pain and suffering may be recovered: drunk/drugged driving accidents, passenger/non-vehicle injuries, wrongful death, intentional accidents, hit-and-run, felony-related accidents, and claims by dependents of uninsured parents

• Allows defendants and their insurers to assert the limitation on uninsured plaintiff recoveries

• Effective date: November 1, 2011
