HB 1530 Summary

• Amends the Public Competitive Bidding Act of 1974 to add a "best value" definition as an optional competitive bidding system that evaluates proposals beyond just price, including past performance, technical approach, risk management, and personnel qualifications.

• Allows awarding public agencies to use best value evaluation criteria in addition to lowest price bidding for public construction contracts exceeding $50,000.

• Permits agencies using best value selection to develop written evaluation plans in advance that specify ranking criteria and submission requirements, which must be included in bid documents.

• Requires that any contract awarded to other than the lowest price bidder must comply with Section 117 of Title 61 (establishing protections for non-lowest-price awards).

• Effective date: November 1, 2011.
