HB 1650 Summary

• Amends the Oklahoma Program Performance Budgeting and Accountability Act requiring state agencies to prepare budgets in program format and collect performance measurement data.

• Imposes financial penalties on state agencies operating without legislative appropriations that fail to submit required reports: 1% for first violation, 2% for second, and 5% for subsequent violations, with penalties directed to the State Auditor and Inspector.

• Requires agencies delinquent more than 30 days to undergo an audit at their own expense, conducted by either the State Auditor and Inspector or Legislative Service Bureau if the auditor cannot complete it within 90 days.

• Directs the Office of State Finance to calculate penalty amounts, reduce agency revenue accordingly, and publish an annual list of non-compliant agencies on its website.

• Becomes effective July 1, 2011 with an emergency clause for immediate implementation.
