HB 1956 Summary

• Amends 69 O.S. 2001, Section 1201 to prohibit county commissioners and the Department of Transportation from opening certain section line segments as public highways under three specific circumstances.

• Prohibits highway opening when all three conditions exist: land is within original boundaries of a former federal facility now held by a public trust, or within property for a new business making $10 million minimum capital investment and hiring 25+ employees at county-average wages; AND all landowners refuse consent; AND the segment is blocked by impassable barriers like rivers, airport runways, security fencing, or active rail lines.

• Preserves property owners' right of ingress and egress to their land regardless of highway status.

• Becomes effective July 1, 2011, with an emergency declaration allowing immediate effect upon passage and approval.
