HB2324 Summary

• Creates the "Prioritization of Public Funding in the Purchasing of Family Planning and Counseling Services Act" establishing a priority order for distributing public funds for family planning and counseling services.

• Establishes funding priority order: (1) public entities, (2) nonpublic hospitals and federally qualified health centers, (3) rural health clinics, and (4) other nonpublic health providers with primary purpose of providing enumerated primary health care services.

• Defines "public funds" to include state general revenue, special account funds, and federal funds from Titles V, X, XIX, XX, and Title X programs.

• Authorizes district attorneys and the Attorney General to bring legal actions against violators, with standing also granted to eligible entities that receive reduced funding due to violations, with attorney fees awarded to prevailing parties.

• Effective date: November 1, 2012.
