HB 2339 Summary

• Creates the Biometric and Social Security Number Religious Exemption Act allowing applicants to opt out of biometric data collection for driver licenses and identification cards based on religious beliefs

• Requires Department of Public Safety to include exemption statement on application forms and prohibits collection, retention, or disclosure of biometric data (facial recognition, fingerprints, DNA, etc.) from applicants who sign the exemption

• Mandates deletion of previously collected biometric data and Social Security numbers within 90 days for exemption applicants; Social Security numbers must be deleted within 72 hours or upon disclosure to Department of Human Services

• Exempts applicants who sign the exemption from receiving driver licenses or identification cards using Radio Frequency Identification (RFID) technology or similar devices capable of storing personally identifiable information

• Provides immunity from liability to law enforcement officers, agencies, the Department of Public Safety, and the State of Oklahoma for any loss or hardship suffered by licensees who sign the exemption; effective December 31, 2012
