HB 2358 Summary

• Establishes a five-year moratorium on the sale or exportation of surface water and groundwater outside Oklahoma, effective November 1, 2012, unless the moratorium is repealed by the Oklahoma Legislature or a comprehensive scientific hydrological study is completed.

• Prohibits all state agencies, authorities, boards, commissions, departments, and political subdivisions from selling or exporting surface water or groundwater outside the state without specific legislative consent.

• Exempts water contracts executed before the effective date that have received legislative approval or were executed pursuant to law, provided the exportation does not exceed 8 million gallons per month.

• Does not apply to water contained in agricultural crops, animal and dairy products, beverages, or processed or manufactured products transported in standard containers.
