HB 2416 Summary

• Modifies unlawful carrying of firearms statutes by distinguishing between prohibited weapons and conduct by concealed handgun licensees who may briefly and openly display handguns without violating law.

• Amends the definition of "concealed handgun" in the Oklahoma Self-Defense Act to clarify that presence must not be "openly discernible to the ordinary observation of a reasonable person" rather than requiring it be "fully concealed."

• Prohibits state and local officials from restricting lawful firearm possession, seizing firearms, or requiring registration during declared states of emergency, with limited exceptions for self-defense, arrests, and evidence collection.

• Provides civil remedies for individuals whose firearms are unlawfully seized during emergencies, including right to sue for return of firearms and recovery of attorney fees and costs in district court.

• Takes effect November 1, 2012.
