HB 2477 Summary

• Allows holders of brewer licenses to serve free beer samples to visitors age 21 and older at their licensed premises.

• Limits samples to a maximum of 16 fluid ounces per visitor per day, with distribution restricted to a designated sampling area on the premises.

• Requires breweries to maintain a current floor plan showing the designated sampling area on file with the Oklahoma Alcoholic Beverage Laws Enforcement (ABLE) Commission and prohibits visitors under 21 from entering the sampling area.

• Restricts sample distribution and consumption to between 10 a.m. and 9 p.m., and clarifies that samples are not considered "sales" under the Oklahoma Constitution but count as beer removed for excise tax purposes.

• Effective July 1, 2012, with an emergency clause allowing immediate implementation upon passage and approval.
