HB 2531 Summary

• Amends 11 O.S. 2011, Section 13-109 to make municipal charter provisions void if they conflict with state planning and zoning law, requiring municipalities to comply with statewide zoning requirements rather than local charter authority.

• Modifies 11 O.S. 2011, Section 15-103 to require petitions for municipal planning or zoning referendums and initiatives to be signed by 25% of affected property owners in the area, rather than 25% of voters who participated in the last general election.

• Defines "affected property owners" as any owner of real property located within the boundaries or bordering the area of the proposed municipal planning or zoning matter.

• Amends 11 O.S. 2011, Section 43-101 to impose a "substantial relationship" test on municipal zoning regulations, requiring them to be substantially related to an important reason and promoting the health, safety, morals or general welfare with clearly stated purposes.

• Amends 11 O.S. 2011, Section 43-104 to require zoning change notices include the important reason or end for the regulation as required by state law; effective July 1, 2012, with emergency clause.
