HB 2631 Summary

• Amends 22 O.S. 2011, Section 18 to expand eligibility for expungement of criminal arrest records to include persons who received a deferred sentence, completed all conditions of the deferred judgment, and had the case dismissed with prejudice.

• Adds new category allowing expungement for persons charged or arrested for crimes actually committed by another person who unlawfully used their name or identification without consent.

• Expands pardon-based expungement to include violent felonies (as defined in Title 57, Section 571) if person received full pardon and 10 years have passed since pardon issuance.

• Clarifies that "expungement" means sealing records to the public while maintaining access for law enforcement agencies for law enforcement purposes.

• Effective date: November 1, 2012.
