HB2636 Summary

• Amends Oklahoma drug court law (22 O.S. 2011, Section 471.6) to require offenders to provide proof of insurance before judges can order the Department of Public Safety to suspend or stay driver license revocation actions.

• Allows drug court judges to enter written orders directing the Department of Public Safety to restore Class D driving privileges for participants who successfully complete the drug court program, with exceptions for drug- or alcohol-related offenses and if all reinstatement fees and conditions are met.

• Amends community sentencing law (22 O.S. 2011, Section 988.8) to authorize courts to issue written orders staying driver license suspension/revocation actions and to restore Class D driving privileges upon successful completion of community punishment, subject to similar conditions and insurance proof requirements.

• Creates new Section 6-212.4 of Title 47 requiring the Department of Public Safety to designate driver license revocation periods as satisfied upon receiving a drug court judge's written order, with electronic notification from county court clerks and authority for the Department to promulgate implementing rules.

• Effective date: November 1, 2012.
