HB 2836 Summary

• Amends 82 O.S. Section 1610 to require floodplain management rules be promulgated only by the Oklahoma Water Resources Board in accordance with the Administrative Procedures Act.

• New or revised floodplain management regulations adopted by local jurisdictions become effective immediately upon passage unless a later date is specified, and must be published in local newspapers within 30 days and sent to the Oklahoma Water Resources Board within 30 days.

• Establishes new procedural requirements including at least 20 days' notice before public hearings for regulation changes affecting specific properties, with written notice to affected landowners.

• Creates new law (82 O.S. Section 1620.2) prohibiting municipal or county governments from taking rights-of-way, easements, or restricting development outside Special Flood Hazard Areas without compensating landowners at fair market value, with specific exceptions for public infrastructure, federally-mandated stormwater management, and certain incentive programs.

• Effective date July 1, 2012, with emergency clause making the act effective immediately upon passage.
