Amends 56 O.S. 2011, Section 2002 regarding the Nursing Facilities Quality of Care Fee assessed on licensed nursing facilities in Oklahoma.

Caps the Nursing Facilities Quality of Care Fee at the amount or rate allowed by federal law once the Oklahoma Health Care Authority receives approval of necessary federal waivers.

Facilities applying for continuum of care licensing by June 1, 2012 and receiving licensure by September 1, 2012 shall be assessed at the same rate as facilities licensed prior to November 1, 2012; facilities failing to receive licensure by September 1, 2012 shall be assessed at the federal-law-limited rate.

Provides that if any provision prevents the state from obtaining federal Medicaid participation, that provision becomes null and void while federal funding is unavailable.

Becomes effective November 1, 2012.
