HB 2908 Summary

• Amends 21 O.S. 2011, Section 1115 to modify penalties for first-degree rape, which becomes a felony punishable by death, life imprisonment, or life without parole.

• Requires mandatory post-imprisonment supervision for individuals sentenced to five or more years (changed from two or more years) for rape violations, in addition to actual imprisonment.

• Establishes that first-time violators of aggravated rape (subsection A of Section 1114) are not eligible for probation on second or subsequent convictions.

• Creates enhanced penalties for repeat sexual offenders: third or subsequent violations of rape statutes result in mandatory life or life without parole sentences.

• Effective date: November 1, 2012.
