HB2923 Summary

• Amends 27 O.S. 2011, Section 13 to clarify that acquisition policies for real property apply broadly to any person, acquiring agency, or other entity acquiring property for public projects (removes limitation to only Section 9 projects)

• Adds new subsection B to Section 13 allowing property owners to raise failure to comply with acquisition policies as written exceptions in condemnation proceedings under 69 O.S. 2011, Section 1708

• Amends 69 O.S. 2011, Section 1708 to allow property owners to raise compliance failures with acquisition policies in written exceptions to the right to take, with potential remedies including dismissal without prejudice or other orders deemed in the interests of justice

• Effective date: November 1, 2012
