HB 3046 Summary

• Amends 27A O.S. 2011, Section 2-6-205 to clarify language regarding unlawful discharges without permits under the Oklahoma Pollutant Discharge Elimination System Act

• Requires facilities, activities, or entities regulated by the Department of Environmental Quality to obtain a permit before discharging any pollutant into state waters

• Grants the Department of Environmental Quality exclusive authority to determine whether a facility requires a stormwater permit, preventing other state agencies from conditioning their licenses or permits on obtaining a DEQ stormwater permit

• Directs the Environmental Quality Board to promulgate rules for stormwater discharge permits that may require case-by-case permits, exempt certain categories, or establish schedules for obtaining permits

• Effective date: November 1, 2012
