SB 1179 Summary

• Authorizes electronic prescribing for Schedule II, III, IV, and V controlled dangerous substances subject to federal requirements in 21 CFR Section 1311 et seq.

• Permits facsimile and electronic transmission of prescriptions with electronic signatures under specified conditions, with exceptions for home infusion pharmacies and long-term care facilities.

• Requires dispensers to transmit recipient and recipient's agent information (name, address, date of birth, identification number) to a central repository along with other dispensation details within 24 hours or real-time as of January 1, 2012.

• Changes drug cleanup fines from mandatory to optional penalties and increases maximum fines to $10,000 for certain violations and $100,000 for more serious violations.

• Redirects collected drug cleanup fines from the OSBI Revolving Fund to the Bureau of Narcotics Revolving Fund, effective November 1, 2012.
