SB 1192 Summary

• Amends the Airspace Severance Restriction Act to prohibit permanent severance of airspace over Oklahoma real property for commercial wind or solar energy systems.

• Wind and solar energy leasing arrangements may only be made with the legally authorized owner of the surface estate, not separate airspace owners.

• Wind or solar energy agreements cannot prohibit surface or mineral estate owners from granting agricultural, hunting, or oil and gas leases, or easements for oil and gas operations and electricity transmission.

• Requires all wind and solar energy agreements entered after July 1, 2010 to be in writing and recorded with the county clerk, including parties' names, property description, and decommissioning terms.

• Designates the act as an emergency measure effective upon passage and approval.
