SB 1205 Summary

• Amends 12 O.S. 2011, Section 2502 regarding attorney-client privilege protections for confidential communications between clients and attorneys

• Adds new provisions (subsections E, F, and G) establishing rules for inadvertent disclosure and waiver of privilege protections

• Specifies that disclosure to governmental agencies in their regulatory or investigative capacity does not waive privilege in favor of non-governmental parties unless the waiver is intentional and involves related communications

• Provides that agreements between parties on disclosure effects are binding only on those parties unless incorporated into a court order, which can extend privilege protection across federal and state proceedings

• Effective date: November 1, 2012
