SB 1242 Summary

• Amends 22 O.S. 2011, Section 991a to add authority for courts to order defendants to reimburse the Oklahoma Attorney General for investigative costs incurred during prosecution of crimes for which the defendant pleaded guilty, nolo contendere, or was convicted.

• Court may impose this reimbursement requirement only if the defendant is financially able to pay without imposing manifest hardship, and if the costs can be determined with reasonable certainty.

• Adds this reimbursement power as an option alongside existing court sentencing authorities, including probation conditions, fines, community service, restitution, and other penalties.

• Maintains existing prohibition against waiving sex offender registration requirements and preserves all other sentencing provisions and protections previously established in statute.

• Effective date: November 1, 2012.
