ENROLLED SENATE BILL NO. 1246 - Summary

• Amends 85 O.S. 2011, Section 410 to address workers' compensation fraud investigations and prosecutions.

• Authorizes the Attorney General to contract with retired peace officers certified by CLEET or CLEET-certified private investigators to conduct investigative services for the Workers' Compensation Fraud Unit.

• Requires that any pending workers' compensation proceeding be stayed after a claimant is charged with workers' compensation fraud under Title 21, Section 1663, and bound over at preliminary hearing, with the stay remaining in effect until final disposition of the criminal case.

• Mandates that all notice requirements continue during any stay of workers' compensation proceedings.

• Becomes effective November 1, 2012.
