SB 1305 Summary

• Amends 22 O.S. 2011, Section 991f to allow courts to grant offenders a grace period of up to one year to begin court-ordered restitution payments when released from custody, if the offender is at or below poverty level.

• During the grace period, no interest accrues on restitution obligations and payments do not increase after the period expires.

• Requires the Department of Corrections to provide offenders with information about their ability to request a grace period upon release from custody.

• Maintains that restitution, fines, fees, and assessments remain continuing obligations until fully satisfied and are not dischargeable in bankruptcy.

• Becomes effective November 1, 2012.
